and not confined to
pecuniary injuries.
Art. 11. Provided also that the said obligation
shall not be confined to cases of Larceny and other
felonies of which the injury to the individual is
merely pecuniary, and that in the way of direct damage:
but shall extend to Murder, Manslaughter,
Mayhem, Rape, and every other species of felony whatsoever
from whence pecuniary injury although only in
a consequential way, or even injury of any kind although
not pecuniary shall appear to have accrued
to any assignable individual or individuals: such
indemnification money in the case of Homicide to
be applied at the discretion of the Court to the use
either of the Prosecutor or Prosecutors, or of the next
of kin to the deceased: for which purpose neither Probate
nor Letters of Administration shall be necessary.

Art. 12. And Whereas it is necessary that it
should be determined what manner of persons
may be committed in quality of Penitentiary Prisoners
to the said Penitentiary House And
Whereas if the undertakings aforesaid in respect of
superior management should come to be fulfilled
it might on divers accounts to be for the benefit as well
of individual prisoners as of the public that
there should exist in proper hands a power to
be exercised on proper occasions of committing
thereto in case of sufficient room therein prison-
-ers
