ers of other descriptions in the same manner as to any
other prison And Whereas nevertheless the exercise of
such power without the consent of the said Governor
might be repugnant to the main end of the said institution
and inconsistent with the economy to be practised
under the same, Be it therefore enacted as follows, viz:
Persons who may be committed to the said Prison
in quality of Penitentiary Prisoners are the following,
1. Any person who in virtue of any Statute present
or future either now is, or shall or might have been
under sentence of transportation.
2. Any person who in the like manner either now is
or hereafter might have been under sentence of hard
labour on board any hulk lying or to lie in the River
Thames or elsewhere.
3. Any person having accepted of his Majesty's most
gracious pardon on condition of transportation, provided
such offender chooses so to be committed instead of being
transported, and not otherwise.
4. Any person who for any felony is under sentence
of committment to Newgate or any other prison.

What, on the footing
of ordinary prisoners.
Art.13. Persons who on the Governor's consenting to
receive them may be committed to the said Prison on
the footing of ordinary prisoners, viz:
