to prevent such liberation as aforesaid.

Art. 4. For intentionally destroying the

Penitentiary House or any building thereto
belonging, or for intentionally damaging the same
in such manner as to afford a facility of escape
to any Prisoner, confinement for life therein or
in such Prison as shall have been built in lieu
thereof is destroyed: for being concerned in attempting
to effect such destruction or endamagement
confinement as aforesaid for any term not greater
than ten years nor less than two years: for making
preparation to effect such destruction or
endamagement, confinement as aforesaid for not
more than five years nor less than one year: and
conspiracy though not followed by any attempt,
shall to this purpose be deemed an act of preparation:
and every such offence shall under the
reservation aforesaid be deemed felony.
