search females, in so far as the search can not without
injury to female modesty be performed by a
person of the male sex: and if any such weapon
shall thereupon be found the same may thereupon
be seized to the use of the Governor of the said House.
Art. 16. And Whereas the lines employed to
delineate the track of delinquency can never be too
determinate, And Whereas the greater the number
of distinct stops that can be marked out therein the
greater is the facility given to detection & conviction
And Whereas the prevention of delinquency by
cutting off all hope of impunity is the truest mercy
And Whereas Justice concurrs with mercy in
requiring that delinquency should be defined rather
by previous warning than by ex-post-facto construction
& condemnation And Whereas so long as
none but offences of the same mischief are comprehended
under the same punishment the multiplication
of penal ordinances is in this way a
safeguard to the subject & not a snare, Be it
enacted that at the instance of the said Governor
the Court of King's Bench may from time to
time make rules & orders declaratory of such acts
