on the part of the Prisoners as in consideration of
the local circumstances of the said Panopticon
Penitentiary House or of any other place in which
under the authority of the said Governor the said
Prisoners or any of them may come occasionally
to be employed shall be deemed Escapes, or Attempts
or Preparations towards escape: in which said rules
and orders to the end that no one may offend
through ignorance shall be contained a specification
of the manner in which the same shall be
promulgated: of which acts an example is
contained in the paper marked [G.]: and if due
promulgation shall accordingly have been made,
and from the nature of the case it shall appear
that a prisoner committing any such act must
have been apprised that the same would be deemed
an escape, or attempt or preparation
towards escape he or she shall be deemed guilty of
such escape attempt or preparation as the case is
although no express nor other proof of the
intention to escape shall have been produced.
