thereof and for the farther & more effectual prevention
of escape and desertion of service as aforesaid
Be it enacted that any person marked
with any such identification-mark as abovementioned
(Sect. X) and not being able to produce
some such instrument as aforesaid, the same
being also according to the nature thereof within
date & unexpired, shall (unless it being within
the time of such instruments being in force the
same should appear to have been by any accident
lost or defaced) be deemed primâ facie a fugitive
from the Penitentiary House, or a Deserter from
his service at the Metasylum, to the purpose
of being liable to be apprehended as such &
convey'd to the said Penitentiary House as herein
after specified.
