or quondam Penitentiary Prisoner shall instead
of being committed for trial to the
County Jail or other local prison to which any
other Offender would for any such offence be
for that purpose committed, be forthwith convey'd
to the said Penitentiary House, there
to remain for trial as herein after mentioned.
Art. 28. Any such prisoner may in
such case be conveyed in any way in which
persons charged with felony are or may be
convey'd from County to County and so to London
or elsewhere there to be dealt with according
to Law: or in the same manner as a Vagrant
under the Statute of the seventeenth year of the
reign of King George the second, Chapter the
fifth as aforementioned: or the Magistrate by
whose order such Prisoner is convey'd may by
special Warrant appoint a person or persons as
Constable or Constables for that purpose: giving
to such Constable or Constables such Warrant of Assistance
mutatis mutandis as is herein before mentioned
(Sect. IX. Art. 5) which said Constable or Constables
shall to the said purpose have the
same
