Art. 31. If in this last mentioned case the arrest
be in any other County, the Magistrate shall at
his discretion either committ the party arrested to the
County or other Jail to which had he never been a
Penitentiary Prisoner he would have been to be committed,
or cause him in manner abovementioned to
be convey'd to the said Penitentiary House: governing
himself in the exercise of such discretion by the consideration
of the expence & principally the expence
of attendance on the part of the persons who appear
likely to be summoned to attend as witnesses: & if,
by any declaration general or particular on the part
of the said Governor he the said Magistrate shall
be satisfied that the extra expence if any would
be defray'd by the said Governor, he is in such case
authorized & required to cause the Prisoner to be
at any rate convey'd to the said Penitentiary House.
Art. 32. Any quondam Penitentiary prisoner
committed for trial to the said Penitentiary House
as aforesaid shall be tried at the next General Sessions
of the Peace for the County in which the
same comes to be situated: or at any subsequent
Sessions to which the Justices in such Sessions may
for due cause adjourn the trial thereof.
Art. 33. Provided that the Court of King's
Bench may for due cause order such Prisoner
to be tried elsewhere at the discretion of the said Court.
