Art. 34. And Whereas if a person who
never had been a Penitentiary Prisoner should by
any mistake be convey'd thither as a fugitive therefrom
or as a deserter from the Metasylum, the
innocence of such Prisoner in respect of such charge
must be fully know to all persons employ'd as
officers or otherwise in an about the said Penitentiary
establishment to a degree of certainty far superior
to what can in general be obtained in any ordinary
mode of trial Be it enacted that in any such
case upon a certificate given by the Chaplain & Surgeon
or any other two officers of the said Establishment
that the prisoner so brought to the said Establishment
as a fugitive or deserter as aforesaid never
had been a Prisoner belonging to the same the
Governor may forthwith give him his discharge.
Art. 35. And forasmuch as by means of
the identification mark abovementioned a certain
criterion is afforded in virtue whereof no person
who shall not have been a felon convict and as
such committed to the said Penitentiary House
can ever on suspicion of so being be arrested without
his own wilful obstinacy & default Be it
enacted that any person who suspects another
of being either a fugitive from the Penitentiary
House, a deserter from the service of a Friendly
Guardian
