10.
Examining Magistrate
give information when a
Prisoner is found with a mark -
Art.10. And to the end that every party intitled to such
indemnification-money as aforesaid may have timely notice
to bring proof of the damage for which the same is to be
paid, Be it enacted that on the committment of any
Prisoner on suspicion of any felony, the Justice of the Peace
or other person by whose authority such committment shall
have been made shall before the departure of the person on
whose application such committment is made, cause the body
of the person so committed to be searched in the proper
place or places for an identification mark: and if any such
place or places for an identification mark: and if any such
mark be to be found, or any ground for suspecting that any
such mark ever had been thereon imprinted, he shall
exhibit the same to the party so applying, and permitt him
to take sufficient note thereof; and moreover shall, by any
other such convenient means as shall present themselves,
cause the same to be made known to all persons interested.

- and in case of assumption
of a false name, to proceed
against him eo nomine
Art. 11. Moreover if before the said Magistrate,
or otherwise, the party so committed shall appear to have unlawfully
assumed as aforesaid any name other than what is
contained in his said identification mark, such Magistrate
shall if thereto empowered by his Office proceed to the examination
& committment of the prisoner for the offence of such
assumption as aforesaid: of if not thereto empowered, shall
then cause the said Prisoner to be convey'd before some
Justice of the Peace or other Magistrate so empowered.
