Art. 38. And Whereas it may chance in divers instances that the

On Petition of a Metasylum-man,
backed by Governor, Parish
to remove the family to
the Metasylum --

family of a quondam Penitentiary Prisoner received into the Metasylum may at the
time of the entrance of such quondam Prisoner thereinto be situated in some remote
part of England, and thereby the whole or some part thereof be incapable of conveying
itself to the said Metasylum or the vicinity thereof And Whereas if
the utmost stoppage that can be made out of the weekly pay of such Metasylum
man or woman be insufficient to the ordinary charge of maintaining such family the
same must be much farther from being sufficient to defray any such extraordinary
expence Be it enacted that upon Petition for that purpose signed by any such
Man or Woman and accompanied by a certificate on the part of the said Governor
attesting the fact of his or her reception into the Metasylum and of his or her inability
to defray the charge of such conveyance the Overseers for such Parish shall as soon as
conveniently may be cause such Family or such part thereof as might lawfully be
removed to its place of Settlement if such Parish had not been its Place of Settlement
to be at the charge of such Parish conveyed to the Metasylum as aforesaid: to wit the Wife,
if any, and unable to bear the charge of such conveyance, and every such child which by
reason of infancy or inability in other respects to provide for itself ought for nurture
or otherwise to be maintained under the care of the Father or Mother thereof: and if within
one month after the receipt of such Petition and Certificate such family shall not have been conveyed and
received as aforesaid, the Governor may provisionaly take upon himself the charge of such conveyance,
and the amount of such charge may after due allowance as aforesaid be thereupon be
levied upon the goods & chattels of any such Overseer in the same manner as the amount
of any such quarterly account as abovementioned

Art. 39. Provided also that for the making of any such supplemental provision

for any such Pauper-family the Overseers for any Parish may contract with the said Governor
for the maintenance of any such Pauper-Family at the Metasylum or any place
not so far distant therefrom but that Husband may have convenient access to Wife and
Parent to Child such Overseers may in lieu of any such supplemental allowance as aforesaid
contract with the said Governor in the same manner as under the Statute of the
9th Year of the reign of King George the first Chapter 7th any Parish may contract
for the maintenance of its Poor within the precincts of the same.
