29 Panopticon Bill Settlement.

by reason that in the said Act no explanation is given of the difference between form and
substance complaints have notwithstanding arisen* that the good purposes of the said Act

have not been so fully accomplished as might be wished And Whereas forasmuch as
under the Law as the same now stands no person being party in any cause can in general
without a Suit in Equity be examined in relation thereto great expences are sometimes
incurred and substantial justice either wholly defeated or delay'd by reason that some
paper of which no one doubt but that the same is of the handwriting of a certain person,
can not although such person be actually present in Court be so proved to be, or by
reason that some paper of the existence whereof no one entertains a doubt happens by
some accident not to be forthcoming at the time Accordingly for the reduction
of expence, for the prevention of false allegations, as well as of disingenuous and vexatious
practice in relation to the premises and for the more effectually and expeditiously
coming at the truth and merits of each case Be it enacted in respect to all
causes other than peneal carried on under or by virtue of this Act, as follows, viz;

If by reason of any insufficient, erroneous, or uncertain statement in respect of any matter
of fact, the recitatory matter of any Order made by a Justice or Justices out of
Sessions (to wit General Sessions) be deemed insufficient to support the imperative or
adjudicative matter thereof, in such case, if evidence sufficient for the purpose can be obtained
in the course of the then present Sessions, such defect shall under the direction
of the Court be accordingly then and there amended: if not, a form, such as if warranted
by the truth of the case will be sufficient, being settled with the parties shall, with or without
the original order be under the direction of the Court transmitted back to the said
Justice, accompanied by an Order of the Court requiring him in lieu of or along with
such defective Order to send back a new one, according to the said form: or if truth will
not permitt, then to send a new Order according to the truth, to the end that the same
may be either confirmed, reversed, or allowed as justice shall require: whereupon the said
Court shall proceed at the next Sessions at which the matter can conveniently be heard.

Art. 43. So likewise in case of any defect in any Examination, Certificate, or
