Copies delivered as true may
be received as originals primâ facie,
in default of declaration of belief
to the contrary, upon Oath —

Art. 49. Every paper purporting to be the copy of an original paper and
delivered as such by a person who upon oath declares his belief of the truth thereof shall
primâ facie be taken to be true: and so shall continue to be subject always to correction by
the original and in the mean time to whatever inference may be drawn to the prejudice
of the truth of such copy if produced on the part of any party in whose possession the
original appears to be: and judgment or order may accordingly be grounded on such copy
in the same manner as on the original, subject always to reversal or alteration in as
far as on production of such original, error shall afterwards have appeared in the
copy, and in as far as by reason of such error such judgment or order shall appear
to be erroneous.

Costs and damages, by reason of
the production of an ungenuine
paper as genuine, or of an erroneous
copy as true, be on the author
of the mistake —

Art. 50. For cost delay and any other inconvenience that shall have resulted
from the production of an ungenuine paper as genuine or of an erroneous copy as true the
party by whose default the error took place or if the fault be in any Agent or Attorney
of his, such Agent or Attorney shall be responsible: and if in such inconvenience there be
included any damage beyond what can be made up by allowance of costs the Court
may to the amount of such damage impose a fine and apply the produce thereof in
satisfaction of such damage.

Exhibition of such ungenuine paper
or erroneous copy, mala fide
punished as a fraud —

Art. 51. Any person who being conscious or entertaining a suspicion of such<lb/
ungenuousness or erroneousness in any material point shall be concerned in producing
the same as true, concealing such his consciousness or suspicion at the time,
may be punished as for a fraud: and to be concerned in keeping back the original
for such purpose shall be deemed a matter of high aggravation.

Like provision for copies of copies,
ad infinitum —

Art. 52. To a copy of a copy, and so on in any degree however remote
the same effect may be given as to an immediate copy, under the same reservations
and conditions as aforesaid.

Court may make an order
conditional, depending on the
subsequent substantiation of
such primâ facie evidence —

Art. 53. The Court on giving a judgment or order grounded on any such

copy may make such judgment or order conditional, declaring that the same shall be
absolute either upon subsequent conclusive proof of the genuineness of such supposed
original or of the truth of such supposed copy (barring accidents) place time & manner
being specified by the Court: or in case of the adverse party omitting to give notice for
that purpose or to appear in consequence thereof: appointing also the mode in which
the fact of the exhibition of such conclusive proof shall be ascertained; and if by affidavit
appointing a form or forms for that purpose: and such judgment or order when become
absolute
