§ 8 Establishment increased a pretence for crushing it Aug 17 1799 Septr 10 1800

Panopticon; – or at most no other than some inconsiderable proportion
of that number: – the making this newly intended
provision, for such of the transportable Convicts as the Jails
will contain, being but a subordinate object in comparison
of the other already spoken of as the principal one.

If appears then, that, if the number afterwards mentioned
as the number proper to be provided for in the Panopticon,
(viz 2150) be meant to be adhered to, the above construction (&
consequently the words that point to it) must be give up
as not being the construction intended: for if it were, the
number so to be provided for ought to be – not the whole
of that number 2150(c) – but some part – some very inconsiderable
part – of that whole number.

If the construction really intended were really thus narrow
the restriction it imports would be such as has not a
single syllable, in either of the Acts referred to (19 G.3 c.74 and
34 G.3. c.84) to warrant it. In the Act of 19 G.3. c.74 "transportable
Convicts
" are mentioned: in the Act of 34 G.3. c.84
(upon which alone the question turns) "transportable and other
"Convicts" are mentioned
: in neither Act, are there any words
of restriction or exception: therefore, in both Acts, all such
Convicts as are therein respectively mentioned – all such Convicts,
without exception – are intended: – consequently, the provision,
made in point of room, ought to be such as is sufficient
for the whole probable number of Convicts, without exception:
sufficient at least for all such Convicts as would otherwise
be consigned to the Hulks, unless there be a special intention
(which it is supposed there is not) of keeping up the Hulks,
after the Panopticon is established.

NB. The word principally was evidently meant to bear reference to
another object, which is afterwards mentioned & considered but as a
secondary one, of the Acts in question – viz the making provision for
"Other", i:e: untransportable, "Convicts".
