such Convicts as are capable of being transported: the other consists of "other
"Convicts
": — that is, all other Convicts whatsoever. It certainly does not oblige
the authorities in question to consign all "transportable", or all "other", Convicts
to the Penitentiary House: because it does not repeal the Acts whereby
transportation and the several other modes of punishment are appointed:
but as certainly it does authorize them so to do, if they think fit. —

In the Act of 34 G.3.c.84 the only words that have any thing
to do whatsoever with the question are as follows —

"Whereas" (p. 121g §1) "by an Act" (19.G.3.c.74) "His Majesty is enabled
"to appoint supervisors for building two Penitentiary Houses for confining
"and employing in hard Labour such persons convicted of transportable crimes
"within England and Wales as are therein mentioned". . . . . . .

"And whereas (p. 1221 §.1.) Penitentiary Houses for England and Wales have not
"been erected in pursuance of the said recited Act, and it will be great public
"utility that a Penitentiary House or Penitentiary Houses should be built for the
"particular purpose of confining transportable and other Convicts within the
"same". . . . .

"Be it enacted" (p. 1222 §.1.) "that it shall .... be lawful .... for .....
"the Commissioners of the Treasury ..... to fix upon the .... Ground the ....
"upon which shall be erected one or more Penitentiary House or Houses for the
"the purpose of confining and employing in hard labour such Convicts as shall
"be removed thither by order of His Majesty....under the powers herein mentioned.

Then comes §3 and empowers his Majesty "to appoint Governors'. who
"shall have the care &c of ..... every ..... Offender ... who shall be delivered
"unto .... their Custdy by the direction of his Majesty.....under such powers
"directions &c as are contained in (24 G.3.c.56....) or under such other
"directions &c as his Majesty shall under the powers of the said Act from
"time to time appoint." —
