3. Third ground of relinquishment – J
3. Third ground for relinquishment the relinquishment of the Penitentiary
Plan – improvements in the existing Jails.
This argument, Your Lordship may remember that
it was already brought to view in the Duke's
suppressed letter of the 14 October preceding. The
more there was said of it on that occasion, the less remains there
will remain to be said about it here.
The A proposition there proved was – that, under
the existing Laws the Laws as they then stood,
the Duke of Portland had no right reasonable cause either
to obstruct the institution of the establishment
or redu join in measures for reducing the mag
decided magnitude of it, whatever might be
the nature and amount of any improvements
made or then likely to be made in the all or any other
Jails.
Another proposition then and there touched upon, but
which will be is of by its importance enough is intituled
to a further discussion consideration in a suborn by itself is
that with the Duke himself Most Noble Secretary of State nor any of his
coadjutors did really conceive himself so much as conceive the Secretary of State to possess
any such right – that in assuming that right
and exercising it he and they knew full well that what
he was doing was in contradiction to the spirit as
well as the letter: to the declared and unrevoked will of
Parliament – and was an act of studied contempt put upon
the authority of Parliament.
