My Lord, there are several pleas, in extenuation,
at least if not in justification which
Your Lordship condone as well as your Lordships
discernment and experience in business will be
disposed to bring forward as Judge or as anxious
rather than be compelled to admitt the existence
of so much turpitude unless they were rebutted
in the first instance.

1. The narrative though true in the main, because
in the main supported by unquestionable documents
may in some parts be not so, being in some parts
supported by no other proof than the narrative
evidence.

2. What is given, though true as far as it goes
may not have been the whole truth and the impression
conveyed by it b may therefore taking the whole
of it together º not be a true one. What for want of explanation sound wrong
unless explained may have received its explanation
which explanation though received by him he has
not reported.

3. Though, considered in itself, the treatment he has
received may appear harsh, yet it would not have
been such as it was, had it not been for something
amiss in his conduct – some intemperance at least
which excusable soever on his part, may must
also be in equity be admitted as an excuse – and
that – difference of situations considered – not an inconsiderable one – on the other side.
