from the consideration of the words of the Act alone coupled with that
of the meaning thus ascribed to it, or from other
circumstances.

Inessentialia?

When the Judges who decided in favour of Ship money
were marked out for punishment – what was
particular understood on all sides was that it was not
enough their the construction put upon by them upon the
law was a wrong construction – it was necessary that
it should not have appeared even in their own presented itself to their own minds
opinion as a right one. No man can be more
glad than I am that we have got rid of Ship money
but as to saying that the Judges who decided
against the claim were in their own minds satisfied of
the illegality of it, and that their false construction was so palpably such as to be known by themselves to be so, it is a point on which I should
have my doubts. But in the present instance I
really have not the shadow of a doubt. In that
case the ground of construction was an extremely complicated
one: if there were principles on one side, there
were precedents on the other. In the present case
it is as simple as it is possible to conceive. How
is a single Act of Parliament, an Act which plain
or not as to certain points, is as plain as possible
upon this point. If the Admitting Parliament to be a
body composed of idiots then the intention ascribed by Mr
King by his construction might really by possibility have been entertained
by Parliament. Admitting Parliament to be
composed as it is really composed; then I such the intention
thus so ascribed to Parliament is not a possible one.
