In a word If this be not an assumption of legislative power
be pleased my Lord, to enable me to say what would
be. Call in imagination – and say, supposing
if for argument sake, a determination taken by a Secretary of State
if an object to the Secretary of State, with or without
in pursuit of whatever object – with or without the
the assistance or connivance of the Treasury, thus to set repeal
in effect a law of Parliament, setting or not to law of his own in the place of a it it law of Parliament
say by what more indubitable unequivocal tokens such in the intention
to that effect could be manifested manifest itself than those by
which it is manifest in the letter.

Say not, my Lord that it is any such attempt is now a days at this time of day impossible: impossibility
can not be is not to be more pleaded against fact. What Thus
is really impossible must is indeed tone that what can not be done in any
instance, and has not been done on this instance
and that is to assume, on the face of Parliament itself a power of superseding the
laws of Parliament. It this way indeed, it may be indeed

truth, that it is impossible to assume a power
of annulling superseding the laws of Parliament. In in another
way the assumption of this monstrous power it can not be said with truth to be impossible
f since your Lordship has seen it the supposition realized: and
that is to assume and exercise that self same power behind
the back of Parliament,
and with the same effect
as if exercised in was so openly – in a clandestine
way, and as it were behind the back of Parliament.
Take any other crime public or private – are devastation,
murder, incendiarism rendered less as innocent
by being clandestine?
