But, my Lord, the short answer is – necessary or
unnecessary – such as it is, the crime was committed
– the criminality as well as the illegality of the act
conduct is, I trust, by this time, pretty well out of dispute.
Suppose it then not to have been a necessary one –
what follows? nothing more than that follow was added
to guilt. In speaking of – not that in this case superadded here to guilt. Far be it for me to say – I am
may most than in any other guilt can exist without far has it ever been from me to think – that guilt can exist
any instance without a dose of folly. On the present occasion I mean an over-dose over proportion extra dose beyond
what is inseparable from its in wrought up and combined in its very essence. The
answer thus given to the plea derived from the
apparent non-necessity of the crime with reference to the attainment
of its object is of no further use, than as it
may serve to do away the more compleatly that
appearance of precipitancy and irreflexion, which is presented
by the absurdity and incoherence of the rhapsodies
by which the criminal views are manifested
and betray'd.
Thus much indeed in necessity is true enough.
