As to other Convicts, it will depend (he says) in the
opinion of the Judges who try them what number of
them it may be proper to confine in the Panopticon.
This supposes (if it means any thing) that there is a
number in which according to in the opinion of the those
Judges Magistrates it will be proper to confine there. But
according to the opinion he declares immediately after
the opinion as his own Your Lordship has already seen: there
is no such number. By what will be the opinion
of the Judges in regard to the number to be contained
in the Panopticon he must therefore be understood, what
would be their opinion, were he to leave to them
in possession of an opportunity of forming an
opinion on that subject. But this opportunity
he is determined they shall not have. For that such
opportunity would be require the existence of this Panopticon
in an extent capable of affording room for convicts
of this class: and this extent it is what he is determined
it is his determination the Panopticon never shall never have, nor
indeed any extent at all.
