Dispensing power
To a man of moderate ambition – the latitude
left by the Parliament might have been sufficient.
Supposing the Penitentiary establishment was set on foot
there would have been three establishments – all of
them equally legal 1. among which he might have
taken its his choice: always understood that his
choice was not to be such as should render the
provisions on behalf of the Penitentiary establishment
– the result and evidently favourite recall of the latest thoughts of Parliament
nugatory and ineffectual and nugatory.
In saying all equally legal – I do not
mean to say all equally conformable to the declared
intention and spirit of Parliament – as apparent
on the face of the two Penitentiary Acts.
His notion was – that in the situation his situation he was
in – and with the support he was made himself sure of, he might
do as he pleased with Acts of Parliament – at least
with Acts so circumstanced: and so as
Lordship he has done accordingly and what he
has been pleased to do with them is at present but too visible.
At the . same time that, for form sake – and to entitle
him the more indispensably to do as he pleased with
them – it would be proper⊞ ⊞ to make a shew of conforming to them: and in that view to say – of them – that he had
examined them – and that he understood the
object of them: and so accordingly he has done.
