If it be not for the purpose of deploying his power hectoring
over Judges as well as Parliaments, to what purpose
it then, that the mention of the Judges is introduced? Who authorised him to ascribe to the Judges When is it that Judges have
a will distrust from that of Parliament? Who is it authorised him to ascribe to them any such will? By Parliament
it was intended that all such Convicts
should go to the Panopticon: for they say Parliament says it is for such
"other Convicts" and they makes no exceptions: and wherefore
is it to be supposed of the Judges, that they will intend
otherwise? If indeed Parliament leaves them a discretion
about the number, they will exercise it as becomes
them. and I do not mean to dispute, but that under the indefinite words of that Act, sup such as they have just been quoted, supposing no future Act made for their discretion – they might be warranted in exercising a discretion in respect to numbers. But how is it possible for them to exercise such
discretion freely, as to the "number to be confined in the within the limits of their privilege the
discretion freely as between member and member, if their

Panopticon", if within the limits of the possible number amount of the numbers which it could be legal for them to put into it, there
be a number which it is rendered physically impossible for them to put
there? into it? – And who is the Duke of Portland that he is to
take from the Judges that discretion which Parliament has
compelled to them? entrusted them with? – To ascertain the probable number of such
Convicts – yes – to ascertain it – as another man would do honestly
and without fraud: that was indeed the promise:– to ascertain it, but not to narrow it.
