After making me the use thus made of the Gaolsin the every as he does
for the purpose of the pretence
in the form of pretence what use was actually made of them
of argument to afford him a pretence for putting a
negative upon the General Penitentiary H Establishment

in practice is more than I can pretend it has lain in my way to know. Supposing
him to have made any such use of them made of them at all - and
supposing any use
either in the Duke's reign or
now in Your Lordship's administration, there is a consideration strikes me
one point consideration which may be not as as one that may have some claim
to notice.

Under this Act (an Act of 1779) transportable Convicts, if consigned
to the then intended General Penitentiary House, are
to be consigned for there, not for the terms for which
they might have been consigned to transportation, but
only from for time certain shorter terms which are therein
specified: and the terms for which they are made
consignable to the existing Gaols, are declared for this
purpose to be so many local and temporary
Penitentiary Houses, § 25 are the same as those for which
they are made definitively consignable to the intended
General Penitentiary Houses.

By what ground authority, and on what ground is it then, that the Convicts,
who have been consigned to the existing Gaols have been
thus disposed of? If on the ground of these the abovementioned clauses in
this Act, then it is by the authority of the several Courts that they
must have been consigned thus disposed of; and in that
case are by the Act the terms, as by the Act they clearly
ought to be, so doubtless they have been. The reduced
