If there were any wor the Act had indeed in it
any words in it applicable to the case – applicable
to the law of conduct the intention of pursuing
which was thus declared – and those words had
that conduct had were found not capable of being
warranted by those words – then indeed it would
be matter of inquiry whether the misconstruction one error
were such as without any evil intention a
man could be supposed capable of falling into.
But here my Lord there were the case affords the words at
all upon which any such construction, right or
wrong could have been put. True it is that
the noble Duke does take upon him to say
I have read these Acts. But how does this mend
the matter case? It is easy enough to see how it
makes it worse –but how does it – how
can it make it better? If the mere talking
of an Act of Parliament and saying
were a sufficient justification to a man for the
putting a contempt upon the authority of it, and
receiving a dispensing power dispensing making a law one of his own head to supersede it with
by the exercise of a dispensing power – not obstructing
merely but preventing the execution of it – the
task of justification would be an easy one indeed.
