Now my Lord with submission to your Lordship
I will venture to two things:

One is that there is not a syllable in the Act
in question that th can give the shadow of a
ground for supposing the legislature to have intended any
such limitations.

Another is that it is not true that the declarer
any body that wrote this letter for him did understand
any such limitation to be intended by the legislation: and that for two reasons: a first because as
already observed there is not a syllable in the
Act as countenance it: and secondly because if
that were the intention of the legislation
the legislation the Act
has words in it which are peculiarly productive exclusive
of any such limitation; then what it requires
is that the Penitentiary should be be created so soon as
conveniently may be
– and says nothing about wanting
for means of opportunities of exportation or
of capacity in county Gaols, and charges the expense
upon a fund widely different from that out of which the expences
of those Gaols are defrayed. – So much for the class of transportable Convicts.
2. So much for the transportable Convicts As to the only remaining description of Convicts
class, he has an additional expedient for keeping them
out of the Penitentiary House, and consequently for preventing
the Penitentiary House from being of any such
magnitude as shall render it possible to put them there. into it.
