By the words of the Act Parliament requires that for
the confinement of Convicts transportable as well as others untransportable "other" than transportable as well
and others likewise as "transportable", in a number unlimited not limited, Pententiary
Houses, in a number equally unlimited, shall be
provided created: and the intention which the Duke of
Portland pretends to look upon, as the intention of Parliament,
expressed by this same Act, is that, no such
Convicts not
in no such House, shall any such Convicts
ever be confined, for where any room can be found anywhere
else in any other legal place of confinement
those existing including not only the places

in any other place, in which on the plea or pretence of
necessity – that: necessity which the it is the object
of the Act to do away – it might, but for the
Act,
have been allowable to confine them but
for the Act
if the Act had not been made.
