Dispensing Power
I must beg leave in this place on this occasion, my Lord, to
state to your Lordship in distinct terms in which
way it is that the Confederacy, by the help of
the Duke of Portland contrived thus to make use of
the County Gaols to undermine the authority of
Parliament: the , because thence it will
be it seen the more distinctly what there is may be of
legality and what of illegality, in the continuance practice
as pursued by made by Your Lordship of the use thus made
of those County Gaols.
When the Act of 1794 was passed for the Penitentiary
Establishment, three modes of punishment were in
use for Convicts of the transportable class: transportation
to N.S. Wales: confinement on board of the
Hulks; and confinement in the existing Gaols.
The two first modes were alike by express appointment of Parliament: in most if not all cases either might be employ'd at the
option of the Judge: whichever was employ'd it
was specified in the sentence – and at any rate in every
sentence passed upon a Convict of the transportable
class, one or other was specified.
The third mode was neither according to the appointment
of Parliament, nor according to the sentence
for in which such cases instances if any, in which in the case of a transportable Convict it may have been specified
in the sentence are out of the question here. It arose
out of necessity – out of the real necessity of the case.
