Take the case of the Prerogative Suspension of the Corn Laws,
and suppose the exigence pleaded not as affording
a title on the ground of natural justice to an
indemnification and that one honourable from Parliament, but as constituting
a justification spite of Parliament – and
as against prosecution in Parliament. Now suppose
now a factitious necessity to have in hiw case
the issue of a spontaneous one. What follows?
that in regard to the subsistence of the people it
depends upon the Crown, at any time, to
establish measures laws of its own, over-ruling the
laws of Parliament.

What then does the Duke of Portland in the
case here in question – the case of the branch part of the
criminal law in raising up his own Gaols
in the place of the Parliamentary Penitentiary House.
It is as if, in the case of the Corn Laws, he were to
produce an artificial scarcity to warrant enable him to justify the spending
the parts at a time when according to under the law
of Parliament, and according to what he knows
to be the views and intentions of Parliament,
they ought to be shut. He makes a scarcity want
of space for convicts in the receptacle appointed
by Parliament (the Penitentiary House) and thus it is
that he makes for himself a justification necessity to justify to him in
shutting them into th receptacles of his own choosing
not authorized by Parliament – the County Gaols.
