Dispensing power
received the sanction of Parliament. This ordinary course
will not satisfy the ambition this vulgar course was is not consistent
with the dignity of the Duke of Portland Mr Baldwin and Mr King.
Parliament has its notions of expedience and "inexpedience":
they have theirs he has his. [It is by their own
notions of expedience and inexpedience that their will
and their conduct is governed and determined and
governed.] It is their will that His will it is that in his opinion is intitled to prevail the preference,
and that by his act has prevailed accordingly. The part
of acquiescence and submission is the part that belongs
to Parliament: and such accordingly is the part which
to this hour has been maintained observed by Parliament.
My notion of the matter I confess is
that even supposing the measure of this crowding
the Gaols had been in itself a good one – had been ever so good in comparison
of the modes of disposal provided by Parliament, it
would have been a most abominable one – being
purchased at that price – at the price of the
respect shown to the authority of Parliament. My own opinions conceptions
of the abstract utility of the Penitentiary System
will not be suspected of being too lukewarm –
and yet most certainly I could never have
had the assurance to propose the measure as an eligible
one, supposing it purchased at that same price.
But if a good measure would become bad, by
being carried into effect by the system of absolute and
independent power assumed by the Mr Baldwin and Mr King in the name of the Duke of Portland – what
shall we say of a bad so bad a measure – of a measure in
itself so indefensible?
