Suppose not too my Lord that this opinion of
the Duke's was meant simply as a piece of good advice
to the Judges – an instruction which they were to be at
liberty to profit from or not, as they thought fit. This
letter was not addressed to the Judges – was not designed
for – nor in the nature of case could be expected ever
to reach the eye the eye of any Judge. His object his manifest object was
not to assert this evidence but to controul and defeat their power.
His supposition the supposition necessarily implied in this
part of the letter was that the opinion of the Judges
would not be accordant with their opinion of his, but
opposite to them inasmuch as they would be conformable
to the manifest will of the legislature this will which
it was his object to disappoint: that his reasons
would not pass as sufficient ones upon the Judges –
would not be regarded by them as warranting them
in relation preferring his measure plan will to the measure will of
the legislature. For on the opposite supposition in
the supposition that the mischiefs the contemplation
of which had made such an impression upon his
mind was to make the same impress a similar an impression of equal efficacy upon the minds
of the Judges those supposed mischiefs would not be later realized.
Either therefore His preventing the Judges from doing
what they would think proper to be done was
excluded in his object – constituted that part of his object
which regarded the Judges, or he had no object
at all. My Lord I will not suppose can do not bring myself a man to
all
