This omission in regard to the Hulk system
it may be said in behalf of the Duke is a proof
rather of bona fides than the contrary rather of the absence of mala fides rathe than of the presence
of it in the case of the Penitentiary System. He
had not (says the apologist) – you yourself do not suppose he had – any
sinister point to gain purpose to effect by the supposition of the
Hulk system – neither in fact did he suppress it:
and yet you see according to the principles of this
letter of his the same fate should attend the old System
that the Hulk system – the already established f under an Act of Parliament and
the Penitentiary system the system only intended to be established under another
Act of Parliament. Suppose illegality – suppose
precipitancy – suppose want of clear view discernment if you please. Yet this
very want of perspicacity may in the eye of candour But these very imperfections – supposing them to exist – ought
be received. serve as evidence a sign of the want absence of mala fides.

My Lord I admitt the want of perspicacity discernment
I admitt it to a dgree of blindness – I admitt
the perspicacity so far and but so far only as
that blindness affords an indication of it may be considered as a proof of it – a perspicacity
in as to the mode of execution – though as
to the design time – (as I shall have made particular
occasion to shew presently) – was ever more
deliberate. But this blindness I rely on presents itself to my view as
a among the proofs of the existence of mala fides instead of the
