V Irresponsibility
2 Minutes no check

1
Objection — Minute Books
an efficient cause of
responsibility. Minute
Book viz. in which the
several acts, with the
names of the several
Members present at
each act ware entered.
p.1

2
Answer. No. — Howsoever
they may serve
for legal responsibility,
they will not for moral.
p.1.

3
The only transgressions
against which in the
way of check such registration
can be of use,
are such as are not
likely to be committed.
p.2

4.
Against such as are
likely to be committed,
ex. gr. such as are here
complained of, (viz. production
of needless vexation)
they do not operate.
p.2

5.
Transgressions against
which they might operate
in the way of check
but which are not likely
to be committed.
1. Transgressions punishable
by impeachment.
p.3

6
2. Do punishable by information
in B.R.
Here agt transgression
they wod of little service — for —
1. The transgression wod
not be entered —
2. Doubts whether view
of the Minutes would
be obtainable —
3. Delation is not probable
either from Members
or subordinates.
p.3

V Irresponsibility
2 Minutes no check

7
Against the transgression
likely to be committed
as above B.R.
affords no remedy.

Neither the infliction
of such vexation by an
Inspector, nor connivance
at it by a Board,
would be punishable in
B.R. p.4

8
B.R. is not in the
habit of regarding
vexation, judicially inflicted,
as a grievance.
p.4

9
Of the responsibility
which signature wod fix
upon the subordinate
the Inspector, the effect
is destroyed by the non-signature
of his superiors
the Board, before whom
alone he could be accused.
p.5.

10
Butts Board was
rendered inefficient by
the same causes.
p.6.

11
In the instance of
the renovated Board
the public duty, the infringement
of it, viz.
by indolence, having in
the old instance attracted
most observation, will
at first be least neglected:
but in time both
branches will be equally
neglected: the same
cause will produce the
same effect. p.6.

V. Irresponsibility
5 Restraining Statute

1
Evidence of the acknowledged
untrustworthiness
of the Board for want of
individual responsibility
afforded by the Act
25G.3.c.52 which takes
away from the Board
the allowing of Pleas for
alledged loss of Vouchers,
giving it to the Court of
Exchequer.

Exchequer Judges act
in public: Audit Comms
in secret p.1.

2.
Proof of the importance
of this circumstance.
But for this the Audit
Board, would be much
the better judicatory.
1. Audit Board examines
Accountants epistolarily
or colloquially ad libitum
Exchequer Judges neither
way.

2. In the particular occasion
here in question, Exchqur
Judge wod determine
on no other than Affidt
evidence: the most
deceptions possible, being
the Oath. p.2.

3.
Of the Act the historical
cause may be seen thro'
the Act itself
Mischief — undue
allowance of Items to
favourites.

No mischief is ever
prevented.

Therefore mischief of
this sort had been exemplified.
p.3

4.
Set means of prevention
thought of, transference
of the power from invisible
Commrs to visible Judges.
p.4.

5.
This supposed fact of
undue favour is merely
inferred from the Statute,
as if from one of Ed. 3d
not from direct evidence.
p.4.

V. Irresponsibility
5. Restraining Statute.

6
J.B. would never have
thought of entrusting such
judication to a Board
with its invisible Members:
never to any but visible
Judges. p.5

7
Of an invisible Board
he would never have entertained
any better expectation
than that of their
sacrificing sooner or later
both branches of duty to
personal convenience.
p5

8
The obstruction given
to the sacrifice of public
duty was not applied
without abridging pro
tante
the power, & with
it the utility of the
Board. p.5.

9
The private branch has
neither that remedy nor
any other to save it
from sacrifice. p.6.

10
The remedy proposed by
J.B. applies to both
branches.

11
By Board, judgements
might be pronounced
publicly after argument,
& with reasons given as
in the Exchequer. p.6
