II. Query Queries in relation to Art. Item 3 (Paid Mess Campbell
and White, Timber Merchants at Millbank, for Wharfage
Rent to 1 Decr 1798 £50:)
No "Receipt" having been taken by the Accountant
at the time, but "a fresh acknowledgment" lately obtained
by him + + day, of the Receipt
th of 1808. and delivered in to the Board in and by his said Letter of
the 24th of May 1808, will that such fresh acknowledgment
be received as a sufficient voucher, or is the circumstance
of his not having taken a receipt for that sum
at the time very time of the transaction, regarded by the Commissioners as binding or
authorizing them to disallow this article of his discharge?
in such manner that no other evidence is regarded
as capable of supplying such supposed deficiency?
and if so, on what principle or rule of law is such
disallowance justified?
