The money being to the satisfaction of the Board
bona fide expended in any way in which the Accountant was
warranted to expend it, and this such expenditure
being, in the judgment of the Board, established by sufficient
evidence, there, if my conception be correct,
ends the authority of the Board.

The Board Commissioners for the auditing of the public accounts are not Commissioners of slaves.
Even supposing (what which however is not the case), that the purpose,
for which the money was put into my hands, had
been that the manufacturing of articles of such and such a specific description to
be delivered by me into other hands, for the service
of government, — say, guns or for example gun-carriages of a certain description — what
the authority of the Board would have extended to, is
the seeing that the money was expended on the manufacture
of gun-carriages; — — gun-carriages bona fide intended by me
to be of that description: what it would not have extended
to, is — the judging whether the gun-carriages
so made by me were of actually accorded with that
description, or to the conceiving of their being delivered by
me to the proper Officer for the use of government.

As to this point, being at a distance from my books
and not having the Statutes to refer to ( I mean the
Statutes on which the authority of the Board depends is grounded) I
confess myself to speak on no other surer ground than that
of a general conception: Nor should I referring the
plea to the jurridicture, if such it may be termed.
In the division of the judicatory itself. The this one reason,
and indeed my only reason for alledging it, being that, should
this happen to be the opinion of the Board, the matter
may be cut — so must the , and on their part, the truth of
ulterior investigation saved.
