J.B. to Audit Board Queries

2. Answer to the Query "Whether the th Contract relating
to the service (the Draft of which was laid before the
"Committee of Finance and reported by them in their
"28th Report has since been duly executed; and
"if so he is required to produce the same."

By executed, I understand to be meant the authentication
given by the requisite signatures to the
written instrument expressive of the agreement between
the parties: not the performance of the acts undertaken
by such agreement to be performed. In this sense any
answer if that neither that Draught nor any other in
relation to the Penitentiary business nor any other between
the Lord Commrs of the Treasury and myself has
now been executed. On this occasion it being true
I hope it is not improper for me to add that such non-execution
has not been produced by any act or
default of mine: my exertions though strenuous and
continued for a long course of years posterior as well as antecedent and to
the said date of my said Examination not having
been able to procure the requisite concurrence on the
other side.
