Two modes, by
either of which
a Judge may be
rendered usually
responsible for his
conduct —
1. By Speech, when
the place he speaks
in is open to the
public.
2. By writing,
when his signature
is given annext to his
acts —
The 2d mode is
the one adapted
to the judicatory
in question — but
not observed by
it.
In the case of a Judge or other public functionary
there are two modes in which his conduct may be
placed in the light, and exposed to the notice of that which which is
exposed to applied by the public eye.
One is, by his sitting and speaking in one
open place, in such sort open as that any one
who thinks fit, may under the necessary expectations,
have access to see and hear what passes.
The other is by the proceedings being in writing
by his signature annext, for the purpose of declaring making
known to the public the part which on each occasion has
been taken by him.
Of these two modes, the first is evidently in a very
productive degree ill adapted to the nature of the cases case here in question: the other
is no less unquestionably well-adapted to it.
