In particular cases, for on particular grounds causes impublicity
is doubtless may be and doubtless, viz. in so many correspondent degrees necessary.
But the utility of publicity, as above indicated, is all-comprehensive:
it conflates the general rule; it
is only in this or that particular special case for this or that
particular special reason that impublicity can be proper
and defensible. Whosoever in any particular case
pleads for it rests belongs to with him to point out
the reason which proves the necessity of it serves for the justification of it in that
particular case.

The reason in by which impublicity is prescribed
will always consist of the mischief in every case be constituted by the inconvenience which
would result from the facts being known to notoriety of the facts with relation to a particular
person or description of persons, during a particular
length of time. To a hostile power for example so long as it
continues hostile; it is not fit the mischief so sufficiently
obvious that would result from his being made informed
acquainted with such measures plans of national defence or offence
as would be in any danger of being defeated by
such knowledge information: consequently with any of the acts of
the secret Boards and other Offices in which the formation
and execution of such plans depends.

Proportionate therefore to the improbity of the officer
is the interest which he has in the establishment and
application of the principle so of irresponsibility
and impubicity
