No adequate responsibility created by secret Minutes.
Senate then secret minutes
Neither the Judges, nor ten times ten, all equally
irresponsible, can by my contrivance be so put together,
even by any other and superior hand, much less by their own,
as to afford constitute a judicature possessing a claim to confidence
equal to that which would be possessed by a
single Judge so acting as to be responsible.
No Vis Without changing its nature, a
Senate could never by any contrivance be made have been said to any
such purpose rendered equal to a British Parliament.

article of charge
individual responsibility
could have
been constituted.
In the paper of charges which I have taken
the liberty to submitt to the invisible judicatory (in question) there
are nine separate charges. Had matters been so
ordered — I mean (to which however I must add, and
to me, the Accountant Suitor, know to have been so
ordered) — that to each article I should have been
assured of seeing the signature of each of the Judges
of which the judicatory were composed, pronouncing
to the extent of the effect produced by his suffrage, Guilty
or not Guilty in relation to that article — this would
to the purpose in question, been acting in the light — this
would have been sufficient to produce the effect of individual
responsibility — this would have been acting on the on the behalf in question
principles of an English Court of Justice penal or non-penal
and not on the principles of a a Senate or</add> German criminal Court
or a Portuguese or Spanish Inquisition.
