These things being considered, there seem to be but
two cases in which a defendant, being honest will
not have reason to wish that to see this mode of scrutiny
on applied to him, and applied to him at the outset
of the cause.
One is where his residence being at a distance
from the seat of the judicatory the savings made in respect of the inconvenience consisting of the quantity of vexation
served by this more expeditious scrutiny, promises not to
be equal to the inconvenience produced by that would be produced by it: viz. the
inconvenience composed of the vexation and expense attached
to the operation a state of personal attendance at the seat of the judicatory, coupled
with journeys to and fro, and demurrage.
The other case is, where - owing to the simplicity of the
Account, and the promptitude of the evidence necessary
and sufficient for the justification of it - any all such queries questions
and other requisitions as can be at ever relevant and necessary
in relation to it, are of such a nature, that
in thus being reduced to writing, the quantity of inconvenience
attached by to the making produced by compliance bestowed on them in
that same written shape, will in point of quantity be still less than the inconvenience
attached, even under the circumstance of vicinity, to
personal attendance.
