Reasons against Vouchers
The tendency here in question is that a tendency to act
in conformity to a supposed rule, putting an exclusion upon all
documents not other than what, as above are contemporary with the transaction of which they speak.
Supposing any such rule to be established and
acted upon, the extent and enormity of the injustice produced would
produced by it would be such, that a slight hint of it may here be sufficient.
It's The effect of it would be a law of forfeiture,
inflicting on all accountants that enormous penalty the grievous penalty so termed
and this on each occasion, all such to the amount of disbursements to which in respect
of which they should it shall have happened to them to omitt to cause to be brought into existence at the very time of the transactions
the species of voucher in question; or, supposing it
brought to into existence, to have been to all such Accountants to whom it shall have happened to have been by any cause
to deprived of it: and this, how justly and truly soever made
the disbursement may have been, and how compleat
and to every Court of Justice how satisfactory, soever
the other producible evidence, by which, if admitted,
the fact of the disbursement would be established.
But, supposing the exclusionary rule in question
ever so just and proper in itself — ever so conducive
to the ends of justice — or to speak more properly
capable of being rendered so by, merely communication to all
such persons whose fate it takes upon itself to dispose
of, yet by the mere want pf such communications it would
stands with the most flagrant be sufficient to taint it with the rankest injustice. The

ex parte facto line, it strikes upon the several
persons, howsoever numerous whose destiny it is, for want of the requisite
communication, to fall victim to it, victims subjected struck
by the inevitable forfeiture which it involves.
