Predominant in every
situation, so it will
be in every do of public
confirming public power
(trust)
Predominant in every situation without exception, it will
be so in every public situation, in every situation conferring
public power which with a view to those for whose benefit it
is desirable that it should be exercised, is called public trust

To counteract this
propensity it has
been his the object with
rulers to give to
subordinate public functionaries
a factitious
interest, operating
on them in the
character either of counter
or a check, according
as it in regard to
each act it were
more for the advantage
of the public that it
should be performed or
abstained form.
To conform the conduct footsteps of men in public trust with to the
line of what has been understood to have been made their
duty, that line which in the department in question has
been understood or prehended to be understood to be most
directly & surely conducive to public interest, legislators and governors
have in every state, with more or less success, employed
for the direction of and controul of this natural and naturally
predominant private interest, what may be termed a factitious public interest
which according as it is employed in producing or preventing
action is called in the one case an incentive
in the other a restraint or check.

it has been found more difficult
the greatest difficulty
has been found to be
in the g causing
men to abstain from
private
transgressions, and
because by the use of the negative
name the name of
negative and positive
transgressions are interconvertible.
Checks are what on these occasions the occasion in question can have most of,
not only because the mischiefs, apt to be produced by apprehended from
action in a wrong sinister direction are apt to be regarded as greater
than those apprehended from action, and because of the facility
which by the application of the negative forms of speech
objects of denominations expressive of objects opposite objects are interconvertible:
thus an incentive to action, to may be termed
a check to indolence.
