5 V. Responsibility
The check constituted by fears of ill-repute shame, depends
upon publicity, and the fear of the check is in proportion
to the quality and degree of the publicity: by publicity understand
publicity in the transaction, on the occasion of which
the conduct of the individual in question in the event of
it being deemed improper, is regarded as likely of a nature/in a way
to expose him to dis-repute: by degree of the publicity,
understand the number of the persons to whom the
transaction including the improper part borne by him
on the occasion of as it is about likely to become known: by the quality
of the publicity depends upon the degree in which the
good or ill opinion — the good or evil offices of each
such person appear are likely, or in his eyes appear likely to
be material to him, to have an influence good or
evil on his welfare.
So far as it goes, i.e. to the extent of the generality
of suffering capable of being inflicted by it, the
check constituted by fear of ill-repute is much more
efficacious, because much more certain in its operation
than the fear of check constituted by the fear of punishment.
Punishment can not be applied without prosecution:
in proportion as prosecution is improbable, so
therefore is punishment: and the check applied constituted by the fear
of punishment weak and inefficient.

may be applied and is applied without prosecution: in this and is therefore
point of view the so much the stronger and more efficient.
