5. That it would necessitate the necessities of which it might be productive would be in
respect of delay and vexation such of which I could not foresee any termination.

6. If, for argument sake, any such award should be made
no to in my partial view of the matter should appear not to be
according to justice, I am without remedy. But I hope
I may stand excused from being with my own hands instrumental
in the making of ground a decision in which
could not for the reason here submitted be according to justice.

Therefore it is that it is in my humble request that
if my ground be alledged which I humbly conceive it need not be
judgment may be pronounced upon the third ground, and no
judgment pronounced nor consequently proof required upon
the first ground.
