§§.5. Third branch of the damage. Damage by non-fulfilment
of the Contract — Grounds of the expected profit — Form from which the
failure ought to be computed i.e. the non-fulfilment — ought so to be computed.

III. Third branch of damage — to which my claim III. Third and last of the three branches of damage — "all loss
has reference — Damage by "and damage" [+] [+]1 (to pursue the
words of the Act) §.4.)

"Samuel Bentham" (my said Brother) "sustained by reason of the non-fulfilment thereof";
viz. of the said Contract,

reasonably have been expected from the fulfilment of the
Contract itself, including such profit those profits again including, as above, such as might reasonably
have been expected from the adaptation of the said inventions
to the purpose of the said Contract. ][

magnitude of which it,
I am unable to concur
how it should
to its whole amount be considered as other

I say, if such it can be called
if but a small part
be allowed, I willingly forgo all claim on the ground of
the two preceding branches. Let At the same time let it not however be said, that, in
and by the terms of this third branch, the second branch is actually
and compleatly included, and that therefore nothing in that second
part port of the account can account could with propriety be added to this third part. branch
For In in this third branch is included what is necessarily included is — not all the whole
of the profit that was ever expectable from the system of mechanical inventions, but only
such part of the whatsoever profit might have been
expectable from it, in so far as it came to be "adapted"
to the purpose of, and employed in, the penitentiary establishment.
The Supposing first adaptation being made —
made to whatsoever extent were found most profitable — there
was nothing to hinder its the like works from being carried on to any extent,
in any other number of places: and this too, even without either additional
advance of capital, or additional trouble of inspection;
viz. [+]3 [+]3 either by taking
in partners, or by
granting
by the grant of licences. And in fact in confidence of the
advantage that was might be expected from that source,
the patents, one or more of them were at more than double the expence, extended to Scotland
and I believe rather though but am not sure, to Ireland.

it was in contemplation — to Ireland.
