it was accepted by Mr Pitt and Mr Secretary Dundas, 17 March

2. Acceptance given to the said proposal at divers times in

4. Day on or before which the Building Penitentiary
House might have been compleated, and the 1000 Prisoners
received into it, but for these a continuance of those delays
which took place on the part of Government [+] [+] amidst regrets
frequently expressed by
official persons concerned
and without any notwithstanding
default ever imputed or surmized my th inefficient solicitations, and without default on the part of myself
(the other contracting party) ever imputed or surmized — say
say 29 Sept. 1795.

N.B. In this assumption 1 year, 1 month and 22 days
is the length of time assumed, as that within which the business
might have been compleated. In the recent case of Drury
Lane Theatre as stated in the public prints, the building was compleated considerably within
the twelvemonth. In the Penitentiary House there would not
have been so much as a fourth part of the build work of
all kinds as in what performed in the institution of that theatre, and the interest it is obvious
in regard to the personal interest, operating as a spur, it is obvious
how much more concentrated the interest was in
this than in that case.

Dundas kne Of this delay length of time, no part
can be considered as necessitated required for the obtainment of
land for the site of the establishment. For Land allotted
to that purpose, was viz. 79 Acres 1 Rood at Battersea
Rise was, at the time of my delivering in my said Proposal
(17 March 1793)
at the immediate command of Government, the it having
been pitched upon for the purpose of a Penitentiary Establishment and valued by a Jury under a former
Act, viz. 19 G.3.c.74 so that nothing and the only need of
the Act of 34 G.3.c.84 was to authorize the substitution of
Contract Management to the Fin Board management the originally intended
Board management: so that to the taking right of taking possession of the land nothing more was wanting than
the payment of the valuation money.
