for the purpose of serving as a
Claim for "Compensation" under the said Act
for his "loss and damage",
"by reason of the non-fulfilment"
of an Agreement or Contract
entered into with him by the
Lords Commissioners of his Majesty's Treasury,
for the maintenance and employment of Convicts,
as therein mentioned:
Submitted by the said Jeremy Bentham to
John Whishaw of Lincolns Inn Esquire
and
John Hullock of Gray's Inn Esquire,
being the Arbitrators named
by the said Lords Commissioners on the one part,
and the said Jeremy Bentham on the other part,
under and by virtue of the said Act.
q.v. Compensation, simple and liberal -
simple is more than is here capable of
being administered: - of that which is physically,
only a part is prudentially capable of being
administered.
1. By the terms of the said Act, (§.4) in speaking of the loss and
damage, sustained by me and my brother hereinafter mentioned
"by reason of the non fulfilment of the said contract" it is declared
to be "just and reasonable" that "for all such loss and damage a
"compensation should be received by me" and that such compensation
should be "liberal" and thereupon it is, that "for the purpose
"of settling all questions, between the public and me the said
"Jeremy Bentham, out of the said Agreement or intended Agreement"
the said contract which in the terms of the said act is
moreover designated by the word "Contract," including of course the
question concerning the amount of such "liberal compensation,"
Arbitrators shall be appointed, as therein mentioned; to wit in
such manner as such Arbitrators have accordingly been appointed.
