2. As to damage, by loss of such profits as might reasonably
have been expected from the said inventions, in which capital had
been so expended as above. For this branch also of the claim, the words
just recited, will, it is presumed, be considered as constituting a sufficient
ground.
3. Damage by loss of such profits as might reasonably have
been expected from the fulfilment of the contract itself; including such
profits as might reasonably have been expected from the adaptation of
the said inventions to the purpose of the said contract. For this branch
of the claim, in addition to those just recited, the following words will, it is
presumed, be considered as constituting a sufficient ground. "And whereas"
(continues the said Act) " it is not now deemed expedient that such contract
"with the said Jeremy Bentham should be carried into effect, but it is
"just and reasonable that the said Jeremy Bentham should be paid
"the sums so by him expended, and should moreover receive a liberal
"compensation for all loss and damage by him and the said Samuel
"Bentham sustained by reason of the non fulfilment thereof,
"deducting from such claims any profit which he may have derived
"from the Land, of which he has been in possession as Leassee under
"the appointment mentioned above".
Thus far the Act. In regard to the third and last branch of
the damage, be the subject of the contract in question what it may,
under the worlds "damage by reason of the non fulfilment of a
Contract" cannot (it is presumed ) surely but be understood to
be included, whatsoever fair profits might reasonably have been
expected from the fulfilment of it.
