Panopticon Bill Leading Points
Sect. IV. intitled Governor's Checks.
1. Legislative Sanction to that part of the
engagement which subjects the Governor to personal examination
before the King's Bench.
2. Provision for filling up the vacancy occasioned
by his suspension or amotion in consequence.
3. The now intended Establishment exempted form
the regulations made for the originally intended one.
☞ The ground for the such an exemption being furnished
in good measure by the abovementioned check, this seemed
to be the perfect place for it the insertion of it under
the former Section would have been in so far prema
Sect. V. intitled Vacation Superintendence. Provis
1. Provision against the contingency of mismanagement
breaking out at times (such as Circuit times)
when neither the King's Bench nor any Judge belonging
to it is at hand to stop it. A number of persons
(such as are usually put into Circuit Commissions) substituted
any one of them to act provisionally as Judge ad hoc, in default
of the Order taken for the purpose by the King's Bench, or Special
Commission from the Crown. ☞ The "Extreme and" Gross
urgent "mismanagement", "extreme and urgent necessity"
are cases supposed by the existing Act. The remedy
given is authority given to authorising the Quarter Sessions, and, appointment
made of appointing an Inspector on purpose to look
out for and report what is amiss to "the Court Justices
of the King's Bench". But what can a Report do, at Circuit times at a
time when there is nobody at hand to whom it can be made? to receive it? Intentional abuse seems to be
which included.
