In this case Two propositions seem here to be involved.
1. that persons thus marked in the way there meant will not be good subjects
and profitable members of society: that their not
being so will leave the stigma in question
for its cause. Let both propositions be allowed. In
the present instance neither of them hold good applies: infamy
being out of the question, corruption of character the
supposed consequence of it is so too. What consistently
the infamy in the painfulness of the operation (burning
and the constant publicity conspicuousness of the mark which
is the result of it. The most painful of all painfulness as affording
modes being preferred to every other is a demonstration
that of its being intended a sort that punishment
is the object in view: the conspicuousness
of the mark, as holding keeping the infamy incipiently
in view. In the present instance pain is out of
the question, for the mode prescribed is that which
is in voluntary use: and as to conspicuousness
the part chosen is one that need never be brought exposed
to view unless when justice requires that it should
be.

But to come closer to the present, how is it that
men when stigmatized in that afflictive way, are
to become the less valuable members of society in consequence?
Is it by not being able to get employment?
In the present instance employment
is not only put within their reach but
secured to them for ever.
